Terms

Who you are dealing with
These terms are an agreement between you and Decibel One LLC ("Decibel One", "we", "us"), which makes the apps listed on our Pricing page. By downloading or using one of our apps, you accept these terms. If you use an app for a business, you accept them for that business too.
Free use
Students, teachers and non-pro users may use every app, with every feature, free of charge. That covers schools and other places of learning, and anyone who isn't paid for the work the app is used on.
Paid work needs a license
Work is paid when you, or the business you work for, are paid for the work the app is used on: a show, an event, an installation, a recording, a rental. Paid work needs one of these licenses for each app used:
- Pro: for one named person and their own paid work, on every Mac they use. A Pro license belongs to that person and cannot be shared with anyone else.
- Company: for a business, one for each Mac the app runs on for the business's work, whoever uses it. A business may move a license to a different Mac, for example when it replaces one, as long as each license covers one Mac at a time.
What a license covers
- The app it was bought for.
- Every release of that app with the same major version number (the first number: a SiGENTEST 1 license covers every 1.x release), for as long as you use it.
- A new major version is a new purchase. The version you have keeps its license.
- A license bought for version 0 of an app also covers every 1.x release of it.
- Versions of an app released before its first licensed version keep their free terms, for any use.
The honor system
Our apps never lock a feature. Without a license, the About box and exported reports say "Student, teacher and non-pro use"; with one, they say "Licensed to" and the licensee's name. We rely on you to buy the license your work needs. You agree not to forge, alter, share, publish or resell a license file, and not to change or hide what an app says about its license.
Ordering and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.
Paddle handles checkout, payment, sales tax and VAT, receipts and refunds, and its Buyer Terms apply to your purchase. Prices are shown in US dollars on our Pricing page. A license is a single payment: there is no subscription and nothing renews.
Refunds
You may ask for a refund within 30 days of buying a license, for any reason. Our Refund Policy explains how.
Using the apps and our sites
You agree not to use our apps, sites or services:
- to break any law or to help anyone else do so;
- for fraud, or to send spam;
- to infringe anyone's intellectual property or privacy;
- to interfere with the security of our services or anyone else's, including by spreading malware, probing for weaknesses or scraping.
Ownership
Decibel One owns the apps, their names, icons and documentation, and these sites. A license gives you the right to use an app; it does not sell you the app or its code. Some apps include open-source components, which come with their own licenses, and those licenses apply to those components.
No guarantee
The apps are provided "as is". We work to make them dependable, but we do not guarantee that they will run without interruption or without errors, or that they will suit your purpose. Test an app in your own setup before you rely on it for a show.
Limits on our liability
As far as the law allows, Decibel One is not liable for indirect or consequential loss, including lost income, lost data or a cancelled performance. Our total liability for any claim about an app is limited to what you paid for that app's license in the 12 months before the claim. Nothing in these terms limits any liability that the law does not allow us to limit, or takes away your rights as a consumer.
Ending a license
We may cancel a license, or stop providing a service to you, for a serious breach of these terms, for non-payment or a reversed payment, for fraud or a risk to security, or for repeated breaches. A cancelled license no longer says "Licensed to", and the app keeps working for free use.
Changes to these terms
We may update these terms, and the date at the top of this page says when we last did. A change never takes away a license you have already bought.
